Terms of Service – Aveline Montréal
Article 1 – Definitions
In these terms and conditions, the following definitions apply:

Right of withdrawal: the period during which the customer may cancel the purchase.

Consumer: a natural person who is not acting in a professional or business capacity and who enters into a distance contract with the seller.

Day: a calendar day.

Fixed-term contract: a distance contract relating to a series of products and/or services with recurring delivery or payment obligations.

Durable medium: any medium that allows the consumer or seller to store information in a way that enables future reference and unchanged reproduction.

Seller: the natural or legal person offering products and/or services to consumers via distance selling.

Distance contract: an agreement concluded through an organized system for the distance selling of products or services, using only one or more means of remote communication.

Means of remote communication: any method that can be used to conclude a contract without the consumer and the seller being physically present together.

General terms: these terms and conditions of the seller.

Article 3 – Scope
These terms apply to all offers, sales, and distance contracts made between the seller and the consumer.
Before a distance contract is concluded, these terms will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where they can access them electronically free of charge.
If any part of these terms is deemed invalid or unenforceable, the remaining provisions will remain in full effect.
Article 4 – Offers
If an offer is valid for a limited time or subject to conditions, this will be clearly stated.
All offers include an accurate description of the products and/or services. Product images are intended to represent the items as closely as possible.
Each offer clearly states the price, possible delivery costs, payment methods, and other relevant terms.
Article 5 – Contract formation
The contract is concluded when the consumer accepts the offer and complies with its terms.
When a purchase is made electronically, the seller will promptly confirm receipt of the order.
Until this confirmation has been received, the consumer may cancel the order.
The seller takes appropriate technical and organizational measures to ensure secure data transmission and payment processing.
The seller reserves the right to refuse an order if there are legitimate reasons, such as concerns about payment reliability or fraudulent intent.
Article 6 – Right of withdrawal
Consumers have the right to cancel their purchase within 30 days of receiving the product, without providing a reason.
During this period, consumers must handle the product carefully. The item must be returned in its original condition and packaging.
Consumers must notify the seller in writing of their intention to return the item within 30 days and ship it back within the same timeframe.
Return shipping costs are the consumer’s responsibility.
Article 7 – Costs of withdrawal
When the right of withdrawal is exercised, all return shipping costs (including international returns) are borne by the consumer.
If the consumer has already paid, the seller will refund the full amount within 30 days after receiving the returned items.
Article 8 – Exceptions to withdrawal
The right of withdrawal does not apply to:

Custom-made or personalized items

Goods made to the consumer’s specifications

Items that cannot be returned for hygiene reasons (e.g., underwear)

Newspapers and magazines

Opened software, CDs, or DVDs
Any such exceptions will be clearly stated before purchase.
Article 9 – Prices
All prices are fixed during the validity of the offer unless changes in VAT or external factors occur.
Price fluctuations on the financial market may affect certain items.
In case of a pricing error, the seller is not obliged to deliver at the incorrect price.
Customs duties and import taxes (if applicable) are the customer’s responsibility.
Article 10 – Conformity and warranty
The seller guarantees that all products conform to the agreement, product description, and relevant laws and regulations.
Defects or missing items must be reported within 30 days of delivery.
Warranty does not cover damage caused by misuse or neglect of care instructions.
Article 11 – Delivery
All orders are processed and shipped with care.
The delivery time will not exceed 30 days, unless otherwise agreed.
If a delay occurs, the customer will be informed promptly.
Article 12 – Contract duration and termination
Contracts involving recurring deliveries may be terminated by the consumer with a notice period of one month.
Fixed-term contracts cannot be automatically renewed unless expressly agreed upon.
Article 13 – Payment
Payment must be made within 7 business days, unless otherwise stated.
Failure to pay on time may result in additional charges for the consumer.
Article 14 – Complaints
Complaints must be submitted within 7 days of product delivery.
The seller will respond to complaints within 30 days and aim to provide a satisfactory resolution.
Article 15 – Disputes
These terms and all related agreements are governed by Canadian law (Province of Quebec).
Any disputes shall be resolved by the competent court of Quebec, Canada.
